Father’s Rights

For many years in the State of Tennessee, it was almost unheard of for a father to get custody of the children while the mother was able to care for them. Over the last two decades, Tennessee has moved away from that simplistic view of the family and moved more towards the center of the spectrum. As discussed previously, the courts have been instructed to address the BEST INTEREST OF THE CHILD{REN} and apply the factors listed in T.C.A. 36-6-106 in determining who to award custody to in the divorce.

With the court’s attempting to apply the maximum parenting time standard to all divorces fathers are no longer relegated to the every other weekend visitation with their children. It is entirely possible for both parents to spend an equal amount of time with their children in today’s divorce court decisions but it takes experienced representation to get to that point.
