CAN I BE CHARGED WITH DUI EVEN IF I HAD NOT BEEN DRINKING?

Yes. The DUI laws are written so that any person operating a motor vehicle under any form of IMPAIRMENT can be charged with DUI. This means that you can be charged with DUI if you have only taken your prescription medications as long as those medications would impair your ability to operate a motor vehicle. Likewise, you can be charged for DUI if you have smoked marijuana or used any other type of illegal drug. Again, having a lawyer knowledgeable in handling these cases is imperative.
